Notice of Public Hearing on 6/13: Zoning Ordinance Amendment for E-10 and E-12 Uses in Residential Districts

The ABINGTON TOWNSHIP BOARD OF COMMISSIONERS will take action June 13, 2024 at 7:00 p.m., to be held at the Township Building, 1176 Old York Rd., Abington, PA and will hold a public hearing on and will consider for adoption, an ordinance amending Part II, General Legislation, Chapter 162, “Zoning”. The title of the Ordinance to be considered is the following:

AN ORDINANCE OF THE TOWNSHIP OF ABINGTON, MONTGOMERY COUNTY, PENNSYLVANIA, AMENDING THE CODE OF THE TOWNSHIP OF ABINGTON AT PART II [GENERAL LEGISLATION], CHAPTER 162 [ZONING], BY AMENDING AND RESTATING ARTICLE III [R1 LOW-DENSITY RESIDENTIAL DISTRICT], ARTICLE IV [R2 LOW-MEDIUM-DENSITY RESIDENTIAL DISTRICT], ARTICLE V [R3 MEDIUM-DESNITY RESIDENTIAL DISTRICT], ARTICLE VI [R4 MEDIUM-HIGH-DENSITY RESIDENTIAL DISTRICT], AND THE USE MATRIX APPENDIX TO REFINE THE PROVISION OF THE E-10 [LIFE CARE FACILITY (CONTINUING CARE)] AND E-12 [NURSING HOME] USES.

The proposed Ordinance is summarized as follows:

Section 1 removes the provisions for Uses E-10 and E-12 from the R1 Low-Density Residential District.  Section 2 removes the Uses E-10 and E-12 from the R2 Low-Medium-Density Residential District.  Section 3 removes the provisions for Use E-10 and E-12 from the R3 Medium-Density Residential District.  Section 4 removes the provisions for Uses E-10 and E-12 from the Medium-High-Density Residential District.  Section 5 amends the Comprehensive Use Matrix and changes the designation for E-10 and E-12 from Conditional Use to Not Permitted in the columns labeled R1, R2, R3, and R4.  Section 6 contains a repealer.  Section 7 maintains severability of the Ordinance.  Section 8 states the ordinance becomes effective five (5) days after enactment.

Additional amendments may be made with respect to the Ordinance prior to or during its final enactment.  Advertisement related to the final enactment of the Ordinance, in final form, including amendments, will be made in accordance with the requirements of the Pennsylvania Municipalities Planning Code.

The full text of the proposed Ordinance summarized above, and a copy of the Zoning Map, as amended, may be examined or inspected by any citizen during regular business hours (7:30 a.m. to 4:30 p.m., Monday through Friday) in the office of the Township, 1176 Old York Road, Abington, Pennsylvania. Interested persons may also examine the full text of the proposed Ordinance at the offices of the newspaper wherein this notice is published, and at the Montgomery County Law Library, Courthouse, Norristown, Pennsylvania.
